Pampa Secure Storage — Effective Date: January 1, 2025
1. Agreement to Terms
By renting a storage unit from Pampa Secure Storage ("Company," "we," "us," or "our"), you ("Tenant," "you," or "your") agree to be bound by these Terms and Conditions. This agreement constitutes a legally binding contract between you and Pampa Secure Storage. If you do not agree to these terms, do not rent or use our facilities.
These Terms and Conditions apply to all locations operated by Pampa Secure Storage, including but not limited to: N. Naida, Doyle, and Brown Street facilities in Pampa, Texas.
2. Rental Agreement & Payment
2.1 Rent & Fees
• Monthly rent is due on the same calendar day each month as the move-in date.
• A late fee will be assessed on rent not received within five (5) days of the due date.
• Payments may be made online at stoneguard.cubby.cc, by phone at 806-669-6006, or in person.
• Accepted payment methods include: credit/debit card, cash, check, and money order.
• Returned checks are subject to a returned-check fee in addition to any applicable late fees.
2.2 Rate Changes
Pampa Secure Storage reserves the right to change monthly rental rates with thirty (30) days written or electronic notice to the Tenant.
2.3 Prepayment & Discounts
Prepayment of rent does not guarantee a locked-in rate. Any rate changes will apply to future billing cycles after the prepaid period expires.
3. Move-In & Move-Out Procedures
• The Tenant is responsible for providing their own lock. Only one lock per unit is permitted unless otherwise approved by management.
• Upon move-in, Tenant agrees to inspect the unit and report any pre-existing damage to management within 48 hours.
• A minimum of ten (10) days written notice is required prior to vacating. Rent is charged through the end of the rental period regardless of early vacating.
• The unit must be completely emptied, cleaned, and the lock removed before the Tenant is released from rental obligations.
• Units not vacated by the agreed-upon date may be subject to additional rent charges.
4. Permitted & Prohibited Uses
4.1 Permitted Use
Storage units may be used solely for the storage of lawful, personal or business property. Units may not be used as a residence, workshop, office, or for any commercial activity.
4.2 Prohibited Items
The following items are strictly prohibited from storage:
• Flammable, explosive, or hazardous materials (gasoline, propane, chemicals, ammunition, etc.)
• Perishable food items or any items that may attract pests
• Live animals or plants
• Stolen goods or any items obtained illegally
• Illegal drugs or controlled substances
• Firearms without proper licensing and compliance with applicable law
• Any items that emit fumes, odors, or that pose a health or safety risk
Violation of prohibited-use policies may result in immediate termination of the rental agreement and/or reporting to appropriate authorities.
5. Facility Access
• Access hours are posted at each facility. Access outside of posted hours is not permitted without prior management approval.
• Tenant is responsible for keeping their access code or key confidential. Do not share access credentials with unauthorized individuals.
• Pampa Secure Storage reserves the right to deny access to any individual who is in default of this agreement or who poses a safety concern.
• The Company may access the storage unit in the event of an emergency, to inspect for damage, or as required by law.
6. Security & Surveillance
Pampa Secure Storage employs security measures including fencing, gated access, and surveillance cameras. However, the Company does not guarantee the absolute security of stored items and is not liable for theft, vandalism, or unauthorized access.
Tenants are encouraged to maintain appropriate insurance coverage for their stored belongings (see Section 8).
7. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PAMPA SECURE STORAGE SHALL NOT BE LIABLE FOR ANY LOSS, DAMAGE, OR DESTRUCTION OF PROPERTY STORED IN OR ON THE PREMISES, WHETHER CAUSED BY THEFT, FIRE, WATER, ACTS OF GOD, NEGLIGENCE, OR ANY OTHER CAUSE.
The Company's total liability to the Tenant, if any, shall not exceed the total amount of rent paid in the three (3) months immediately preceding the event giving rise to the claim.
8. Insurance
Tenant's personal property is stored at the Tenant's sole risk. Pampa Secure Storage does not provide insurance coverage for stored property. Tenants are strongly encouraged to obtain their own insurance through a homeowner's policy, renter's insurance, or a standalone storage insurance policy.
By signing or electronically agreeing to this contract, Tenant acknowledges that they have been advised to obtain insurance and do so at their own discretion.
9. Default, Lien & Auction
9.1 Default
A Tenant is in default if rent or other charges remain unpaid after the due date. Upon default, the Company may restrict or deny access to the unit.
9.2 Lien & Auction
In accordance with the Texas Self-Storage Facility Lien Act (Texas Property Code, Chapter 59), Pampa Secure Storage has a lien on all property stored in a unit when a Tenant is in default. If default is not cured within the required statutory period, the Company may auction or otherwise dispose of the stored property after proper written notice has been provided.
Proceeds from any sale will first be applied to outstanding rent, fees, and costs of sale. Any surplus will be remitted to the Tenant as required by law.
10. Termination of Agreement
Either party may terminate this rental agreement with proper written notice as outlined in Section 3. The Company reserves the right to terminate this agreement immediately and without prior notice in cases of:
• Violation of these Terms and Conditions
• Storage of prohibited items
• Conduct that threatens the safety or security of the facility or other tenants
• Fraudulent or misrepresented information provided at move-in
11. Alterations to Unit
Tenants may not make any alterations, modifications, or improvements to storage units, including drilling, painting, or affixing permanent fixtures. Any alterations made without written consent may result in immediate termination of the agreement and the Tenant may be charged for restoration costs.
12. Governing Law & Dispute Resolution
This agreement shall be governed by and construed in accordance with the laws of the State of Texas. Any disputes arising from this agreement shall be resolved in the appropriate courts of Gray County, Texas. The prevailing party in any legal dispute shall be entitled to recover reasonable attorney's fees.
13. Modifications to Terms
Pampa Secure Storage reserves the right to modify these Terms and Conditions at any time. Tenants will be notified of material changes via email or written notice at least thirty (30) days prior to the effective date. Continued use of the storage unit after the effective date constitutes acceptance of the updated terms.
14. Entire Agreement
These Terms and Conditions, together with any signed rental agreement or lease addendum, constitute the entire agreement between the Tenant and Pampa Secure Storage and supersede all prior discussions, representations, or agreements, whether written or oral.
